New Nevada Real Estate "Buyer's Waiver of NRS Chapter 113 SRPD Rights" form...coming soon

Changes include: updating the title to "Buyer's Waiver of NRS Chapter 113 SRPD Rights" and a bold-face reminder that "This waiver does not cover the Energy Consumption Evaluation in NRS 113.115."

As a reminder, NRS 113.130(3) allows a buyer to waive any of their rights under the SRPD statutes if the waiver is in writing, signed and notarized.

Of all the disclosures required in a residential resale transaction, these two (SRPD and energy) are the only ones that may be waived. No other current disclosure is waivable, including: lead-based paint disclosure; construction defect disclosure; and the CIC resale package. If the disclosure applies to the home, the disclosure must be made, regardless of the type of transaction or the identity of the seller.
